Mary Kennedy DECEASED.

In the name of God, Amen. I, Mary Kennedy of Foxtrap, South Shore in the Electoral District of Harbor Main Newfoundland, being very sick and weak in body, but of perfect mind and memory, do make and ordain this my last will and Testament.

First: I give and bequeath to my son Joseph Kennedy the two pieces of cultivated land that my husband the late Absalom Kennedy willed and bequeathed to me, one piece of land is situated by the pond in Long Pond and the other piece is situated in Foxtrap by the Dunn’s Hill Road.

I also give and bequeath to my son Joseph Kennedy on account of his kindness in supporting me and making me comfortable in my old days for seventeen years all the property viz dwelling house, goods & chattels, Stable & Cellar that my son John Kennedy was to take possession of at my death but he being was killed over thirteen years ago. My son Joseph Kennedy is to live on the property and enjoy it on account of what he has done and is doing for me. My grandchildren have never done anything towards supporting me or keeping the ground fenced or cultivated, Therefore I think my son Joseph Kennedy is entitled to the property.

And I do hereby utterly disallow, revoke and disannull all and every other former Testaments, Wills and Bequests by me in anywise before named willed and bequeathed, ratifying and confirming this and other to be my last Will and testament.

In witness whereof I have hereunto set my hand and seal this Seventeenth day of April in the year of Our Lord One thousand nine hundred and nine. MARY X (her mark) KENNEDY

Signed, Sealed, Published, pronounced and declared by the said Mary Kennedy as her last Will and Testament in the presence of us (having been first read over) in her presence and in the presence of each other, have hereunto subscribed our names as witnesses.
