 Newfoundland Will Books

In re
     James Prendergast       deceased.

In the name of God Amen. I James Prendergast of Harbor Grace Conception Bay in the Island of Newfoundland Dealer, being of sound and disposing mind memory and understanding but mindful of my mortality do make this my last will and testament in manner following that is to say,
First I give and bequeath all my right title and interest in and to a certain dwelling house and premises situate in the Town of Harbor Grace aforesaid (the same being held under lease from Mary Innott Widow of which about thirty three years are unexpired) unto my affectionate daughters Catherine & Lucy and my son John and also to my daughters Teresa & Elizabeth equally and to their heirs and assigns with & under the provisions and limitations hereinafter expressed.
Secondly, I further give and bequeath unto my aforesaid daughters & son all the moveable property and household goods that I may be possessed of at the time of my decease to be divided among them in equal shares.
Thirdly, I do further as touching the provisions and limitations hereinbefore named declare it to be my wish and will that my aforesaid daughters for the considerations aforesaid do mutually assist to pay and discharge all my lawfull debts and also to assist and provide for my beloved but afflicted son John untill it please the Almighty to restore him to his right reason that then he shall have his fifth part of the property so willed and bequeathed subject to the same provisions and limitations as the other four shares.
Fourthly I do hereby appoint my beloved daughter Catherine my executrix and my son in law Andrew Drysdale my executor to this my last will and testament hereby annulling and revoking all other and former wills at any time heretofore made or executed by me.
In witness whereof I have hereunto set my hand and seal this seventeenth day of February in the year of our Lord one thousand eight hundred and forty.
