RICHARD McCarthy deceased
In the name of God. Amen. I Richard McCarthy of Carbonear in the Island of Newfoundland, being of sound mind and memory, do this first day of August in the year of our Lord one thousand nine hundred and one do make and publish this my last will and testament in the manner and form following, that is to say; First I give and bequeath to my son the Rev. Felix D. McCarthy that piece or parcel of land situate on the south side of Water Street in Carbonear aforesaid, with the dwelling house shop and store thereon and at present occupied by Mrs. Webber to hold to him, the said Rev Felix D. McCarthy, his heirs and assigns for ever. And I hereby give and bequeath to my son Richard Henry McCarthy the Western part of what is known as “Spring Mount Cottage” situate in the town of Carbonear aforesaid and at present occupied by me as a place of residence, with the lands and erections on said several pieces or parcels of land and all appurtenances, thereto belonging or in anywise appertaining. And I do hereby give and bequeath to my daughter Mary Eliza McCarthy, an interest in my general property, the said interest not to exceed the sum of four hundred dollars, the said sum of four hundred dollars to be collected for her the said Mary Eliza McCarthy out of my general property by my executor whenever it will be convenient for him to make the said collection. And also I will and order that should my son Richard Henry McCarthy not return to Newfoundland, within five years from the date of my death, to take possession of or otherwise make claim to the said western part of what is known as “Spring Mount Cottage” and the pieces or parcels of land thereto belonging and which I have bequeathed to him in this my last will and testament the said western part of “Spring Mount Cottage” and the said pieces or parcels of land shall become the property of my son Rev. Felix D. McCarthy. And lastly I do hereby will and order that my wife Hannah McCarthy have the use of the said Western part of what is known as “Spring Mount Cottage” with the lands and erections on said several pieces or parcels of land and all appurtenances, thereto belonging until the time of her death. And I do hereby ordain constitute and appoint the said Rev. Felix D. McCarthy sole executor of this my last will and testament hereby revoking all former wills by me made. In witness whereof I have hereunto set and subscribed my hand and seal the day and year first above written. Richard McCarthy (LS) Signed, sealed, published pronounced, and declared by the said Richard McCarthy as his last will and testament in the presence of us who in his presence and in the presence of each other have hereunto subscribed our names as witnesses hereunto.
